– Article 1: These Measures are formulated in accordance with the Customs Law of the People’s Republic of China, the Law of the People’s Republic of China on Import and Export Commodity Inspection, and other relevant laws and regulations, in order to regulate the inspection, quarantine, and supervision of import and export cosmetics.
– Article 2: These Measures apply to the inspection, quarantine, and supervision of cosmetics imported into and exported from the territory of the People’s Republic of China.
– Article 3: The General Administration of Customs is responsible for the inspection, quarantine, and supervision of import and export cosmetics nationwide. Customs offices at all levels are responsible for the implementation within their respective jurisdictions.
– Article 4: Imported cosmetics shall be inspected and quarantined by the customs at the port of entry. Exported cosmetics shall be inspected and quarantined by the customs at the place of origin or the port of departure.
– Article 5: Importers and exporters of cosmetics shall be responsible for the quality and safety of the cosmetics they import or export, and shall fulfill the obligations of declaration, inspection, and quarantine in accordance with these Measures.
– Article 6: Customs shall implement risk management in the inspection, quarantine, and supervision of import and export cosmetics, and may adopt measures such as prior inspection, on-site inspection, and sampling inspection.
– Article 7: Imported cosmetics shall comply with Chinese national standards and technical specifications for cosmetics. If there are no national standards, the relevant industry standards or internationally recognized standards shall apply.
– Article 8: Export cosmetics shall comply with the standards and requirements of the importing country or region, and shall also meet the requirements of Chinese laws and regulations.
– Article 9: Customs shall conduct inspection and quarantine on the basis of the declared information, and may require the importer or exporter to provide relevant certificates and documents.
– Article 10: Cosmetics that pass inspection and quarantine shall be released. Cosmetics that fail inspection and quarantine shall be handled in accordance with relevant laws and regulations.
– Article 11: Customs shall establish a credit supervision system for import and export cosmetics enterprises, and implement differentiated supervision measures based on the credit status of enterprises.
– Article 12: These Measures shall come into force on the date of promulgation.
