EU CPNP and Responsible Person: the unglamorous duties that still stop first shipments

Article 4(1). Only cosmetic products for which a legal or natural person is designated within the Community as “responsible person” shall be placed on the market.

Article 4(3)–(5) (as consolidated): the responsible person shall ensure compliance with the relevant obligations set out in the Regulation. For a cosmetic product imported into the Community, each importer shall be the responsible person for the specific cosmetic product he places on the market; the importer may, by written mandate, designate a person established within the Community as the responsible person who shall accept that designation in writing.

Article 13(1). Prior to placing the cosmetic product on the market the responsible person shall submit, by electronic means, the information listed in that article to the Commission (the Cosmetic Products Notification Portal), including the category and name of the product, the Member State in which it is to be placed on the market, contact details, the presence of substances in the form of nanomaterials, the frame formulation, and the original labelling.
