Tmall Global New Requirements for CBD Cosmetics

Tmall Global released rules regarding the “Tmall Global Cosmetics Platform Standards” that will take effect on March 29, 2021.

It indicates that the listed cosmetic products should have correctness of products information such as the brand, product specifications, product name, country of origin, cosmetic shelf life, limited use date, cosmetic net content, usage method, warnings, whether it contains CBD (cannabidiol), etc. The product information filled in the attribute column must be true. Comply with the relevant standards of the original sales destination country/region. Be sure to mark the shelf life and production date of cosmetics.

In the statement, it clearly specified the requirement on CBD products that When the products contain CBD (cannabidiol), it is necessary to be uploaded the THC test report of the corresponding product and the THC content should not exceed 0.3%.

In order to better regulate the market management of the Tmall Global cosmetics industry and improve consumers’ shopping experience for cosmetic products, Tmall Global update the “Tmall Global Cosmetics Platform Standards” to strengthen the management of the cosmetics industry.

This rule is announced on March 22, 2021, and will take effect on March 29, 2021

Among the data, the sales of cosmetics reached 55.8 billion RMB, a year-on-year increase of 40.7%, outperforming the overall growth in the total retail sales of consumer goods. Support News: China Animal Testing Free in Conditions since May 1st, 2021

From May 1st, imported general cosmetics will be exempted from animal testing.” 

As soon as the “Regulations on the Administration of Registration and Filing of New Cosmetics” were issued by the National Medical Products Administration (NMPA) of China, There were some international cosmetics brands that responded to the opportunity immediately. 

Recently, Brazilian beauty group Natura&Co revealed in the 2020 Q4 financial report that its British brand “The Body Shop” and Australian brand “Aesop” will enter the Chinese market and will complete product notification (filing) in China in the first half of this year. Previously, the above two brands did not officially enter the Chinese market because they did not meet the requirements for animal testing of imported cosmetics. 

Does this mean a new round of imported beauty brands coming to China?

According to the “Regulations on Supervision and Hygiene of Cosmetics” promulgated by the health administration department of the State Council in 1989, China has always required all imported beauty and personal care brands to conduct animal testing on their products. This has turned away many imported cosmetics brands that oppose animal testing specially after EU totally banned the animal testing on 2013. 

In recent years, China Cosmetics management departments have begun to gradually relax restrictions on imported cosmetic products.

In 2014, China no longer requires domestic made non-special use cosmetics to undergo animal testing, but still requires all imported cosmetics and domestic special-use products to do the animal testing to ensure product safety. 

Four years later, Cruelty Free International (CFI, “International Anti-Animal Testing Organization”) has reached a cooperation with relevant Chinese authorities to take measures to exempt imported cosmetics from animal testing in China and help more “no animal testing” “International beauty brands enter the Chinese market. 

In January of this year, the French Federation of Beauty Businesses (FEBEA) stated that France will become the first EU country where general cosmetics can be exported to China exempted from animal testing by issuing the official goverment GMP certificate which is only acceptable certificate for China animal testing free policy. “The Chinese authorities have agreed to French shampoo, shower gel, blush, mascara, Personal care and beauty products such as perfume no longer need to be tested on animals before entering the Chinese market.” 

China Animal Testing Free in Conditions since May 1st, 2021

On Mar 4, 2021, China NMPA finally released the formal version of “Management Standards of Cosmetics Registration and Filing Documents”. It specifically listed that imported general cosmetics will be exempt from animal testing from May 1st, 2021 under certain conditions.

Article 33:

(2) If the manufacturer of general cosmetics has obtained the relevant qualification certification of the production quality management system(GMP/ISO)issued by the government department of the country (region), and the product safety risk assessment result can fully confirm the safety of the product, it is exempted from animal testing, except for the following situations:

1. The product claims to be used by infants and children;

2. The product uses new cosmetic raw materials under safety monitoring period;

3. According to the quantitative grading and scoring results, the filing person, the domestic responsible person, and the production enterprise are listed as key supervision objects. (not full fill yet)

China NMPA issued the “Management Standards for Cosmetics Registration and Filing Documents”

In order to implement the “Administrative Measures for the Registration and Filing of Cosmetics”, standardize and guide the registration and filing of cosmetics, the National Medical Products Administration (NMPA) has formally issued the “Management Standards for Cosmetics Registration and Filing Documents”, which are hereby promulgated and shall come into force on May 1, 2021.

The National Medical Products Administration (NMPA) organized 7 draftings of Testing methods which have been reviewed and approved at the plenary meeting of the Cosmetic Standards Expert Committee and are hereby released as The revised or newly added inspection methods of the “Cosmetics Safety and Technical Standard (2015 Edition)” shall be included in the corresponding chapter of the Standard (see Annex 1 for details).

Among the above 7 Testing Methods, the first 4 are revised from current Cosmetics Safety and Technical standards, which will be implemented from May 1, 2021; The last 3 methods: One In Vitro Testing Methods and Two efficacy testing methods are newly added to Cosmetics Safety and Technical standards and become effective as the date of this notice.

From the 3 newly published testing methods, we should be aware that efficacy testing is inevitable coming on the way, NMPA added efficacy testing such as  Anti-freckle, Whitening Effect, and Anti-hair Loss Effect to fulfill the efficacy claim management in the not long future. Meanwhile, we still should keep faith to China cosmetics cruelty free since NMPA still adding the matured In Vitro testing into the testing standards.

According to the latest data from the EUROPEAN FEDERATION OF ETHICAL AND ALTERNATIVE BANKS AND FINANCIERS (FEBEA), China has became the largest exporter of French cosmetics products for the first time in 2020. 

According to FEBEA’s historical data, China was only France’s seventh-largest beauty exporter in 2018. In 2019, China became France’s fourth-largest beauty exporter. In 2020, China has climbed to the top. 

At present, beauty products are France’s second-largest export industry, second only to the aviation industry, and make a huge contribution to France’s net overseas sales. Due to the impact of the new COVID-19 pandemic, France’s total exports of beauty products in 2020 were 15.7 billion euros, a decrease of 11.8% from 2019. At the same time, French export sales to China increased by nearly 20.7%. 

In terms of sub-categories, China is by far the largest overseas market for French lipsticks. A quarter of the lipsticks exported from France are sold to China; skin care products and makeup products from France are also very popular in China; France Soap exports have achieved strong growth all over the world. Among them, China ranked first, with sales increasing by 22%, followed by Europe, with an increase of 19%.

At the same time, sales of perfumes and eau de toilettes exported by France fell by 16% and 27.9%, respectively. Part of this is due to travel bans imposed by various countries, fewer new fragrance product releases and the closure of travel retail. 

FEBEA President Patrick O’Quin said in a statement: “Cosmetics have proven their ability to face this special situation throughout the year. We have taken various actions to defend the interests of members as much as possible. We are particularly involved in the promotion of the export process through a qualification certification platform that obtains a certain number of required documents. More than 50% of France’s cosmetics are exported to other countries, and the entire French cosmetics export industry employs 130,000 people. Despite the turbulent environment, French cosmetics still account for 24% of the global market share.’Made in France’ remains an important asset for the sector and the entire economy.”

8980 Ingredients in the New Inventory of Existing Cosmetic Ingredients in China (IECIC)

On January 26, the China National Institute for Food and Drug Control issued the “Notice on Soliciting Opinions on the Inventory of Existing Cosmetic Ingredients in China” (hereinafter referred to IECIC).

The new version of IECIC deletes 57 kinds of existing ingredients and add 140 new ingredients.

According to the notice, the newly released lists contain a total of 8980 kinds of raw materials, which is 190 new added compared with the 8783 kinds included in the current version IECIC 2015. 

However, CosmeticsBridge noticed that it also listed the 7 deleted raw materials and the 50 raw materials that to be included in the “List of Prohibited Cosmetics” (draft for comments), such as 2,6-bis(2-hydroxyethoxy) Base) -3,5-pyridinediamine HCl, formaldehyde, 2,4-diaminophenol, andrographolide, etc.

In other words, the total number of new IECIC has increased from the original 8783 to 8,923, andit is 140 new added raw materials in total.

According to the new catalog, there are three main sources of 140 additional raw materials. 1. Cosmetic raw materials that have passed the review. For example, on December 21, 2020, the four raw materials lauroylarginine HCl, methoxy PEG-23 methacrylate/glyceryl diisostearate methacrylate copolymer, phosphorus Acyl oligosaccharide calcium and steareth-200 are among them. 

Secondly, it added the restricted ingredients, preservatives, sunscreens, colorants, hair dyes, such as Acid Red 195, Bromoform, Phenol green and so on, which were not included in the “IECIC 2015” BUT listed in the “Safety Technical Specifications for Cosmetics” (2015 Edition). Third, it is the original raw materials. According to the specific usage of the raw materials in the cosmetic administrative licensing management system, a large number of orchid extracts and algae extracts have been added.

Furthermore, Cosmeticsbridge noticed that TSN (MELIATOOSENDAN) bark / root bark extract, LEPIDIUM APETALUM seed extract Was added to the catalog.

Additionally, hump oil, Samara (Elaeagnus mollis diel) oil, Glabridin three kinds of raw materials and as the review by the audit are added to the catalog. 

First public disclosure of the upper limit of the use of raw materials

According to the “Regulations on the Supervision and Administration of Cosmetics” (hereinafter referred to as the CSAR), requires registrants and fillers to conduct safety assessments on cosmetics and new raw materials. The revision of the new IECIC mentioned that the safety of cosmetic raw materials is closely related to the safety of cosmetic products. A complete raw material database is the basis of cosmetic risk assessment.

However, the current IECIC only contained the names of used raw materials, and did not sort out the use details of raw materials, and could not provide a reference for risk assessment. Therefore, in addition to adjusting the names of raw materials (including Chinese/English/INCI names) in the new IECIC, some new raw materials have been added to the highest historical usage of some raw materials for the first time.
