Notice on Revising Prohibited Ingredients of Cosmetics

On March 26, 2021, According to the national drug control policy requirements, China Institute for Food and Drug Control proposed to list raw materials such as CANNABIS SATIVA FRUIT, CANNABIS SATIVA LEAF EXTRACT, CANNABIS SATIVA SEED OIL and(CBD)cannabidiol as prohibited ingredients of cosmetics in China. 

Currently, it is open for public consulting.  You can provide comments, suggestions, and feedback to [email protected] before April 19, 2021.

It will affect both local market and Cross-border ecommerce like Tmall Global.

If you are familiar with the Inventory of Existing Cosmetic Ingredients in China (IECIC 2015), currently the following ingredients are listed as positive use for China cosmetics which are all just be mentioned in the above statement.

Therefore, in Chinese markets, CBD cosmetics are not fully unreachable by the Chinese consumers. There are actually various CANNABIS seed and leaf extract cosmetics that exist to fill the gap of CBD cosmetics. Meanwhile, due to the cross-border e-commerce policy, and consumers can purchase the CBD cosmetics from the cross-border e-commerce platform like Tmall Global and JD Worldwide.

However, If the proposal comes to implementation, the Cannabis-related ingredients along with the CBD ingredients will not be used in China anymore. And most importantly, it may also be banned on Cross-border e-commerce platforms. The reason we can reference is that in 2020, Sep. Tmall Global published the prohibited cosmetics use ingredients list according to the current prohibited ingredients list in Safety Tehnical standard 2015. Which means once the ingredients been listed in the prohibited ingredients list formaly, highly chance the Tmall Global with other cross-border e-commerce platform will also ban the CBD ingredients as well.
