Following the release of the “Inventory of Existing Cosmetics Ingredients (IECIC 2021)” by the NMPA on April 30, Today (May 28), two copies of the “List of Prohibited Use Cosmetic Ingredients” and “List of Prohibited Plant (Animal) Raw Materials for Cosmetics” were also officially released. Among them, four kinds of cannabis-related raw materials including cannabidiol (CBD) are officially banned.
There are a total of 1284 banned raw materials in the revised “List of Prohibited Use Cosmetic Ingredients” and 109 raw materials have been banned in the “List of Prohibited Plant (Animal) Raw Materials for Cosmetics” which means starting today, China has clearly prohibited the use of 1393 raw materials in Cosmetics.
The most important update is that Cannabidiol (CBD) is banned in the “List of Prohibited Use Cosmetic Ingredients”; the “List of Prohibited Plant (Animal) Raw Materials for Cosmetics” shows that CANNABIS SATIVA FRUIT, CANNABIS SATIVA SEED OIL, and CANNABIS SATIVA LEAF EXTRACT banned.
This means that the whole cannabis related products are banned in China now.
The announcement also stated that since the date of the announcement, cosmetics registrants and filing persons shall not produce or import cosmetics that use prohibited raw materials specified in the “List of Prohibited Use Cosmetic Ingredients” and “List of Prohibited Cosmetics (Animal) Raw Materials” in the formulation of products.
According to the provisions of Article 59 of the Cosmetics Supervision and Administration Regulations (CSAR), if a company uses raw materials that are prohibited from being used in the production of cosmetics, it will be fined up to 30 times the value of the goods; if the circumstances are serious, it may also be ordered to suspend production, business suspension or Revocation of cosmetics licenses, etc.; the main person in charge of the enterprise will also face punishments such as fines or a lifetime ban on cosmetics production and business activities.
Can hemp related cosmetics that have been produced and on the shelf still be sold?

But it is clear that from today, CBD and hemp cosmetics will officially withdraw from the China market.
